This policy describes the types of information we may collect from you or that you may provide when you access the Vensaas Partner Portal (the "Platform"), in strict accordance with the Information Technology Act, 2000, and the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 ("SPDI Rules").
1. Information We Collect
When you apply to become a Partner, we collect Personal Data and Sensitive Personal Data or Information (SPDI) as defined under Indian law, including but not limited to:
- Identity Data: Full name, age, gender, photograph (selfie).
- Contact Data: Mobile number, WhatsApp number, City, State.
- KYC Documents (SPDI): Government-issued identification such as Aadhaar Card or PAN Card for background verification and tax compliance (TDS).
- Financial Data (SPDI): Bank account numbers and IFSC codes provided for commission payouts.
- Location Data: GPS coordinates collected via the Partner App during shop visits and check-ins to verify lead generation authenticity.
2. How We Use Your Information
We use the information collected strictly for lawful purposes directly related to our business functions, including:
- Verifying your identity, age, and eligibility to operate as an Independent Partner.
- Processing commission payouts to your designated bank account.
- Complying with Indian taxation laws (e.g., deducting TDS under section 194H of the Income Tax Act).
- Tracking field performance, visit locations, and lead generation validity.
- Communicating with you via WhatsApp, SMS, or email regarding training, updates, and payouts.
3. Data Sharing and Disclosure
We do not sell your personal data. We may share your information only under the following circumstances:
- Service Providers: With third-party payment gateways (e.g., Razorpay) or communication APIs (e.g., Twilio) strictly to facilitate payouts and communications.
- Legal Compliance: When required by law, subpoena, or other legal processes initiated by Indian law enforcement agencies or courts.
4. Data Security & Retention
We implement reasonable security practices and procedures as mandated by Rule 8 of the SPDI Rules, 2011. Your data is encrypted in transit using SSL/TLS and stored on secure, access-controlled databases.
- Consent for Verification: By submitting your KYC details (Aadhaar/PAN), you explicitly consent to the verification of such documents via third-party authorized APIs for onboarding validation.
- Retention Period: To comply with Indian corporate assessment and income tax laws (such as TDS deductions), your KYC documents, financial data, and payout records will be retained for a period of 8 years from the end of the relevant financial year, even in the event of account termination.
5. Your Rights and Grievance Officer
Under the SPDI Rules, you have the right to review the information you have provided and request corrections. You also have the right to withdraw your consent at any time, recognizing that withdrawing consent may result in the termination of your Partner account.
